Terms of Use and Privacy Notice – "What's it worth?" App
These terms govern the use of the app "What's it worth?" (German title: "Verkaufswert Rechner") for Android and iOS (the "App"). The provider is Rafael Kolloch, Twofingers Apps, Emscherdelle 9, 44289 Dortmund, Germany, email: info@twofingersapps.de (see also the legal notice). The general privacy policy applies in addition.
1. Description of the service
The App assists in researching market values of used items based on eBay sales data. All displayed values are non-binding estimates and do not constitute a professional appraisal or investment or sales advice.
2. AI item identification
The App includes an optional feature that identifies items from a photo. The photo you take is transmitted via our server to the AI service Claude, operated by Anthropic PBC (USA), where it is analyzed to generate search suggestions.
- Results are generated automatically by an AI model. AI can make mistakes. We do not warrant that suggestions are accurate, complete, or suitable; verify results yourself before making important decisions.
- You are responsible for the photos you take and submit. Do not photograph people, ID documents, private records, or other sensitive content, or any content you do not have the rights to.
- Misuse of the feature (in particular for unlawful purposes) is prohibited. Anthropic's usage guidelines apply in addition (Anthropic Usage Policy).
- We may adjust the feature's scope, availability, and free usage allowances, or discontinue the feature, provided this does not devalue identifications you have already purchased (section 3).
3. Free allowance and purchases ("identifications")
A limited number of free AI identifications is available per day; the current number is shown in the App. Additional identifications can be purchased as a pack through the respective app store (in-app purchase).
- Purchases are processed by Google Play (Android) or the Apple App Store (iOS); your contracting partner for payment processing is the respective store operator. The price is shown in the store dialog before purchase and includes applicable VAT.
- Purchased identifications do not expire and are used once your free daily allowance is exhausted.
- Purchased identifications are tied to the specific App installation on your device (anonymous installation ID, see section 6). They cannot be transferred to other devices. Deleting the App or its data may forfeit any remaining balance.
- Right of withdrawal: when purchasing digital content, you consent in the store's checkout dialog to immediate performance and acknowledge that you thereby lose your statutory right of withdrawal (Art. 16(m) of the EU Consumer Rights Directive, § 356(5) German Civil Code). Refunds are governed by the respective store's policies.
4. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body, or health. In cases of slight negligence, we are liable only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected. In particular, we are not liable for financial losses resulting from purchase or sale decisions you base on the estimates or AI suggestions shown in the App.
5. App stores
The terms of the respective store apply in addition (Google Play Terms of Service or Apple Media Services Terms and Conditions, including Apple's standard Licensed Application End User License Agreement (EULA) for apps obtained through the App Store). In case of conflict, these terms prevail in the relationship between you and us to the extent permissible.
6. Privacy in the App
The controller is the provider named above. In addition to the general privacy policy, the App processes the following data:
- Photos (AI identification): The photo you take is transmitted via our server to Anthropic PBC (USA) for analysis. We do not store the photos. According to Anthropic, content submitted via its API is not used to train its models by default. The transfer to the USA is based on the EU-U.S. Data Privacy Framework and/or the EU Standard Contractual Clauses. Legal basis: Art. 6(1)(b) GDPR (providing the feature you requested). The feature is only activated after your explicit confirmation in the App.
- Installation ID: A randomly generated, anonymous identifier of the App installation. It is used to allocate the free daily allowance and purchased identifications and does not allow any conclusions about your identity. Legal basis: Art. 6(1)(b) GDPR.
- IP address: When the AI identification is used, the IP address is processed briefly for abuse and overload prevention (rate limiting). Legal basis: Art. 6(1)(f) GDPR (legitimate interest in secure, cost-covering operation).
- Purchase data: For in-app purchases we receive a purchase receipt (token) from the store and store it together with the installation ID and the credit balance in order to credit purchases and prevent multiple redemptions. We do not receive payment details (e.g. credit card data); these are processed exclusively by Google or Apple as independent controllers. Legal basis: Art. 6(1)(b) and (f) GDPR.
- App integrity: To protect our interfaces against abuse, requests include a device/app integrity check (Firebase App Check with Google Play Integrity or Apple App Attest). Google or Apple processes device-related data for this purpose. Legal basis: Art. 6(1)(f) GDPR.
- Search queries: Your search terms are transmitted to eBay to retrieve results. eBay's privacy notices apply.
- Diagnostics and usage data: The App uses Firebase Crashlytics (crash reports) and anonymized usage statistics. You can disable both in the App's settings. Legal basis: Art. 6(1)(f) GDPR.
You have the rights under Art. 15–21 GDPR (access, rectification, erasure, restriction, data portability, objection) and the right to lodge a complaint with a data protection supervisory authority. Contact info@twofingersapps.de to exercise them. Because the installation ID is not linked to any person, we may need the ID shown in the App to process access or erasure requests.
7. Changes
We may amend these terms with effect for the future, in particular in the event of changes to the features, the legal situation, or the service providers used. The current version is available at this address.
